Board of Education Makes Progress on BCC Middle School #2

Yesterday, the Montgomery County Board of Education adopted a resolution providing for continued public park operations at Rock Creek Hills Local Park until construction of BCC Middle School #2 begins in July 2015.  The resolution also indicates that the deeds to the property have been prepared and approved by all of the interested parties and are ready to be executed and recorded in the County land records.  Once recorded, transfer of the site back to the Board of Education will be complete.  Montgomery County Public Schools is currently conducting a series of public meetings to develop design elements for the new school.  The BOE’s resolution appears after the break . . .

Subject: Bethesda Chevy-Chase Middle School #2—Use Agreement

After a reimbursement to the Maryland-National Capital Park and Planning Commission (M-NCPPC), the Rock Creek Hills Local Park will be conveyed to the County for the new Bethesda Chevy-Chase Middle School #2. The County then will transfer Rock Creek Hills Local Park to the Board of Education. The deeds to the property have been prepared and approved by all of the interested parties and are ready to be executed and recorded in the County land records.

Following the Board of Education’s direction, staff in the Department of Facilities Management has negotiated the terms and conditions of a use agreement with M-NCPPC. This use agreement would allow the Parks Department in the M-NCPPC to continue to manage and operate the Rock Creek Hills Local Park until the construction activities for the new Bethesda Chevy-Chase Middle School #2 are ready to commence in July 2015, pending approval of necessary construction funds in the Capital Improvements Program. Under the use agreement, M-NCPPC would bear the liabilities associated with the operation of the park. Therefore, I recommend approval of the following resolution to execute the use agreement with M-NCPPC:

WHEREAS, The Rock Creek Hills Local Park will be conveyed to the Board of Education for the new Bethesda Chevy-Chase Middle School #2; and

WHEREAS, The deeds to the property have been prepared and approved by all of the interested parties and are ready to be executed and recorded in the County land records; and

WHEREAS, A use agreement with the Maryland-National Capital Park and Planning Commission has been developed and is ready to be executed; and

WHEREAS, The use agreement would allow the Montgomery County Department of Parks in the Maryland-National Capital Park and Planning Commission to manage and operate the Rock Members of the Board of Education 2 October 8, 2013
